2. Use of the website
By using this website, you agree to use it lawfully and not interfere with its security or operation. Website content is provided for general information and browsing; it is not an individual medical diagnosis or guarantee of treatment results.
You may not reproduce our original website design, photography or other protected content without permission, except where lawfully permitted. Supplier trademarks and product images remain the property of their respective owners and are used subject to applicable authorisations.
3. Product information and pricing
We aim to show clear product descriptions, available sizes, prices and relevant charges before an order is placed. Prices are displayed in South African rand (ZAR). Harmony Touch Aesthetics (Pty) Ltd is not VAT registered, and we do not charge VAT as a VAT-registered vendor.
Availability is subject to confirmation. We may correct obvious display errors and will not knowingly mislead customers about pricing or product characteristics. Any corrections or cancellations will be handled in line with applicable law.
4. Orders and formation of sale
Before finally placing an online order, customers must be able to review the transaction, correct mistakes and withdraw without placing the order. A submitted order is a purchase request; acceptance is confirmed through the website or an order-confirmation communication as appropriate.
We may contact you if a product is unavailable or if essential order information is incomplete. Your transaction record and applicable terms should be made available electronically.
5. Payment and security
Available payment methods and the complete amount payable, including any disclosed delivery charges, will be presented before checkout. Online payments may be handled by an independent payment service provider such as Yoco if enabled on the website.
We use payment arrangements appropriate to secure electronic transactions. Customers must not provide card details through unsecured email or ordinary messaging.
6. Delivery and collection
Delivery and collection options, applicable fees, eligible locations and estimated timeframes are displayed at checkout or communicated before order confirmation. Risk and responsibility in delivery are governed by applicable law and the agreed delivery terms.
Unless otherwise agreed, statutory ECT Act requirements about order performance and non-availability apply. If a delivery is delayed or an order cannot be fulfilled, we will provide the remedies required by law.
7. Returns, exchanges and refunds
Our separate Returns, Exchanges & Refunds Policy sets out the process for cancellations, defective goods, exchanges and refunds. Qualifying online goods purchases may be cancelled within seven days of receipt under section 44 of the ECT Act, subject to statutory exclusions.
The Consumer Protection Act provides additional rights relating to goods that do not meet statutory quality standards, including remedies under section 56. Nothing in these Terms excludes rights that cannot lawfully be excluded.
8. Appointments and treatments
Treatment descriptions, availability and prices are subject to professional assessment and confirmation at booking. Some treatments require a prior consultation, screening or informed consent. Results differ between individuals and no outcome is guaranteed.
Where a third-party booking platform is used, its applicable booking terms may also apply, provided they do not override mandatory South African law. Any appointment-specific cancellation policy must be clearly displayed before confirmation.
9. Skincare recommendations and product use
Online questionnaires and product suggestions are general guidance only. Product compatibility may depend on individual skin characteristics, sensitivities and other factors. Review manufacturer instructions, ingredient labels and warnings and consult a suitably qualified professional where appropriate.
We do not promise that a skincare product will diagnose, cure or treat a medical condition unless an authorised and legally supported claim applies.
10. Promotions and discounts
Only offers expressly published and valid at the time of purchase apply, subject to stated eligibility, dates and exclusions. Discounts are not automatically cumulative unless clearly indicated.
The laser package discount, where advertised, applies according to the published package conditions and does not automatically reduce standalone appointments or product prices.
11. Privacy and communications
Personal information is processed in accordance with our Privacy Policy and POPIA. By contacting us or placing an order, you agree to receive necessary transactional messages. Promotional electronic communications are handled in accordance with applicable marketing and opt-out requirements.
12. Website availability and third-party links
We take reasonable care in operating the website but cannot guarantee uninterrupted availability. Third-party booking, delivery and payment services may have additional lawful terms. We are not responsible for unrelated third-party content, subject always to any liability imposed by law.
13. Liability and statutory protections
Nothing in these Terms excludes or limits liability or consumer remedies where doing so is prohibited by law, including rights under the ECT Act and Consumer Protection Act. Any lawful limitation of liability applies only to the extent permitted by South African law.
14. Complaints and governing law
Please contact harmonytouchaest@gmail.com with complaints or disputes. We will endeavour to resolve matters fairly. These Terms are governed by the laws of the Republic of South Africa, without removing any mandatory consumer remedy or lawful right of recourse.
15. Changes to these Terms
We may update these Terms from time to time. The version applicable to a completed transaction will be determined by the terms presented when it was concluded, subject to applicable law. The latest public version will be available on our website.
